By accessing or using Lexpresso ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and continued use constitutes acceptance of changes.

2. Description of Service

Lexpresso is a vocabulary learning platform that helps you generate CEFR-filtered flashcards from YouTube and Netflix videos. The Service includes:

  • Chrome Extension for generating flashcards from YouTube and Netflix videos
  • Web application for flashcard review and learning management
  • Spaced repetition algorithm (FSRS) for optimized learning
  • Timestamp-linked vocabulary context from original videos

3. User Accounts and Eligibility

3.1 Account Creation

You must create an account to use the Service. You agree to provide accurate, current, and complete information and to update it as necessary.

3.2 Age Requirement

You must be at least 13 years old to use this Service. Users under 18 require parental or guardian consent.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

4.1 Permitted Use

You may use the Service for personal, non-commercial vocabulary learning purposes.

4.2 Prohibited Activities

You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Use the Service to generate flashcards from copyrighted content you do not have permission to use
  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Interfere with or disrupt the Service or servers
  • Transmit viruses, malware, or harmful code
  • Impersonate others or misrepresent your affiliation
  • Resell, redistribute, or commercially exploit the Service

5. Educational Use and Content

5.1 Educational Purpose

Lexpresso is designed for personal educational use to help you learn vocabulary from video content. You are responsible for ensuring your use complies with applicable laws.

5.2 Third-Party Content

Your use of Lexpresso with third-party video platforms (including YouTube and Netflix) is subject to those platforms' terms of service. We are not affiliated with YouTube, Google, Netflix, or other video platforms.

5.3 User Responsibility

You should use Lexpresso with content that is publicly available and appropriate for educational purposes. You are responsible for your use of the Service.

6. DMCA and Copyright Infringement

6.1 Copyright Policy

We respect intellectual property rights. If you believe content on Lexpresso infringes your copyright, please submit a DMCA takedown notice.

6.2 DMCA Takedown Process

To file a DMCA notice, email support@lexpresso.io with:

  • Your contact information (name, address, email, phone)
  • Identification of the copyrighted work
  • Identification of the infringing material (URL, deck ID, or specific flashcards)
  • A statement that you have a good faith belief the use is not authorized
  • A statement that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

6.3 Takedown Timeline

We will respond to valid DMCA notices within a reasonable timeframe. Infringing content will be removed promptly upon verification.

6.4 Counter-Notice

If you believe content was removed in error, you may submit a counter-notice. We will forward it to the original complainant and may restore content within 10-14 business days unless legal action is initiated.

7. Subscription and Payments

7.1 Free Trial

New users receive a free trial with 3 video processing credits. No payment information is required for the trial.

7.2 Paid Subscriptions

Paid subscriptions are available on a monthly or annual basis. Pricing is displayed on our Pricing page.

7.3 Payment Processing

Payments are processed securely through Stripe. We do not store your credit card information.

7.4 Billing and Renewal

Subscriptions automatically renew unless canceled before the renewal date. You will be charged the then-current subscription fee.

7.5 Cancellation and Refunds

  • You may cancel your subscription at any time through account settings or the Stripe Customer Portal
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months or unused services
  • Free trial users are not eligible for refunds

8. Service Availability and Modifications

8.1 Availability

We strive to provide reliable service but do not guarantee 100% uptime. The Service may be unavailable due to maintenance, updates, or unforeseen technical issues.

8.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

9. User Data and Privacy

Your use of the Service is subject to our Privacy Policy. By using Lexpresso, you consent to our data practices as described in the Privacy Policy.

10. Intellectual Property

10.1 Service Ownership

Lexpresso, including its source code, design, logos, and branding, is owned by us and protected by copyright, trademark, and other intellectual property laws.

10.2 User Content

You retain ownership of flashcards you create. By using the Service, you grant us a limited license to store and display your flashcards to provide the Service to you.

11. Disclaimers and Limitations of Liability

11.1 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11.3 Maximum Liability

Our total liability to you for all claims related to the Service shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Lexpresso and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

13.1 Termination by You

You may terminate your account at any time through account settings or by contacting us.

13.2 Termination by Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will provide notice when reasonably possible.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Japan. Any disputes arising from the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lexpresso.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms without restriction.
